These Terms and Conditions ("Terms") constitute a binding agreement between you ("Customer," "you," or "your") and Infinity Inboxes ("Company," "we," "us," or "our"). These Terms govern your access to and use of the services available through infinityinboxes.com (the "Services").
BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE ENTERING INTO THESE TERMS ON BEHALF OF AN ORGANIZATION, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THAT ORGANIZATION. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.
Infinity Inboxes provides email infrastructure solutions including the setup and management of email mailboxes and domains for cold email outreach. We are a reseller of domains and mailboxes from third-party email service providers and vendors. As such, we are not liable for outcomes resulting from the use of such accounts, including any actions taken by third-party providers such as Google or Microsoft.
You must provide accurate and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials, for all activity that occurs under your account, and for notifying us immediately of any unauthorized access. You may not sell, transfer, or share your account credentials with any unauthorized party.
All services are billed on a recurring subscription basis. You authorize us to charge your payment method for applicable fees. All fees are quoted and payable in US dollars. Prices are subject to change with notice. If payment fails, we reserve the right to suspend or terminate your access to the Services.
ALL FEES PAID ARE FINAL AND NON-REFUNDABLE. THERE ARE NO REFUNDS UNDER ANY CIRCUMSTANCES WHATSOEVER. THIS INCLUDES, WITHOUT LIMITATION: DISSATISFACTION WITH THE SERVICES, FAILURE TO USE THE SERVICES, ACCOUNT SUSPENSION OR TERMINATION (WHETHER BY YOU OR BY US), SERVICE INTERRUPTIONS, THIRD-PARTY PROVIDER ACTIONS (INCLUDING DOMAIN OR ACCOUNT SUSPENSIONS BY GOOGLE, MICROSOFT, OR ANY OTHER PROVIDER), TECHNICAL ISSUES, DELIVERABILITY OUTCOMES, OR ANY OTHER REASON. BY SUBSCRIBING TO THE SERVICES, YOU ACKNOWLEDGE AND AGREE THAT ALL PAYMENT OBLIGATIONS ARE NON-CANCELABLE AND ALL FEES ARE NON-REFUNDABLE REGARDLESS OF THE CAUSE OR CIRCUMSTANCE.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds or credits will be issued for unused portions of the billing period. Upon cancellation, your access to the Services will terminate at the end of the paid period.

You agree to indemnify and hold Infinity Inboxes harmless from any claims, fines, or penalties arising from your failure to comply with the CAN-SPAM Act or any other applicable marketing or anti-spam laws.

The Services may provide access to domains, products, and services owned by third parties, including but not limited to Google and Microsoft ("Third-Party Products"). These Third-Party Products are subject to their own terms and conditions. You acknowledge that third-party providers may suspend, block, or flag domains, accounts, or messages in their sole discretion, which may result in downtime or unavailability of the Services. Infinity Inboxes shall not be liable and shall have no obligation to issue refunds or credits for any suspension, downtime, loss of access, blocking, or loss of use resulting from third-party actions.
All content, features, and functionality of the Services, including text, graphics, logos, and software, are the exclusive property of Infinity Inboxes and are protected by United States and international intellectual property laws. You retain ownership of all data you submit through the Services ("Customer Data"). By using the Services, you grant us a limited license to use Customer Data solely as necessary to provide the Services.
We may suspend or terminate your access to the Services immediately, without prior notice, if: (a) you breach these Terms; (b) your use poses a security risk to the Services or other customers; (c) you engage in fraudulent or illegal activities; (d) you violate or are at high risk of violating the CAN-SPAM Act; (e) a third-party vendor suspends our access to services required to provide the Services to you; or (f) required by applicable law. We will have no liability for any consequences resulting from suspension or termination. You may cancel your account at any time through your account settings.
TO THE FULLEST EXTENT PERMITTED BY LAW, INFINITY INBOXES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify, defend, and hold harmless Infinity Inboxes and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law, including the CAN-SPAM Act; or (d) any claim that your Customer Data infringes or misappropriates any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree to arbitration on an individual basis only.
CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last updated" date. Your continued use of the Services after any modification constitutes acceptance of the updated Terms. We reserve the right to modify, suspend, or discontinue the Services at any time without notice or liability.
